Miami has narrowed its investigations of illegal bank foreclosures in the state and it is now directly investigating Deutsche Bank. This action has been arrived at after the bank was named the trustee in nearly half of all the fraud investigations carried out for over 6 months.

In many cases looked into, the bank refused to produce the original mortgage note or proof of validity of the transfer note. Moreover, it has no problems with admitting that its actions should be discussed in court. It is sad to note that some minority mortgage defaulters do not have access to a legal expert who can explain to them the importance of these documents in their case. As a result, they assume they don’t have any defense and consequently fail to show up during hearings.

Deutsche bank has been accused of purchasing note and mortgages and trading on them without any thought of the borrowers. The investigations revealed that the bank management approved the purchase of many notes from the secondary market. After purchase, the bank attempted to foreclosure the defaulters' houses. Deutsche Bank has been accused of intimidating, giving default judgments and foreclosuring houses as quickly as possible, especially for those homeowners who lack the knowledge on foreclosures.

Foreclosures have risen sharply in the last 3 years. In 2006, just about 11,000 foreclosures were auctioned. This is in sharp contrast to the over 56,000 foreclosures reported in 2008. The worst affected groups are the minorities who lack the knowledge on their options when it comes to bank foreclosures.
